The Holland Law Firm today joined the fight against two of the country's largest players in the opioid industry, Purdue Pharma and Abbott Labs, filing suit as special assistant state’s attorneys for St. Clair County, Illinois on behalf of both the County and the State of Illinois for harms and losses caused by the opioid epidemic. Eric Holland cited the opening paragraph of the lawsuit as the foundation of the case:
“A pharmaceutical manufacturer should never place its desire for profits above the health and well-being of its customers. Drug manufacturers have a legal duty to ensure their products are accompanied by full and accurate instructions and warnings to guide prescribing doctors and other healthcare providers in making treatment decisions. They must tell the truth when marketing their drugs and ensure that their marketing claims are supported by science and medical evidence. Defendants broke these simple rules.”
According to Holland, the County and State’s losses were directly caused by false and misleading marketing that was designed to and did in fact lead to an overwhelming spike in demand for opioids and, ultimately, what is widely known to be the opioid crisis throughout the State. According to the complaint, “Defendants, through a sophisticated and highly deceptive and unfair marketing campaign that began in the late 1990s, deepened around 2006, and continues to the present, set out to, and did, reverse the popular and medical understanding of opioids. Chronic opioid therapy—the prescribing of opioids to treat chronic pain long-term—is now commonplace.” The lawsuit points out that Purdue has already agreed to settle civil and criminal charges involving its nameplate opioid, OxyContin, paying the United States over $600 million for its false and misleading marketing.
The lawsuit was filed by attorneys Eric Holland and David Cates and their firms as special assistant state’s attorneys to State’s Attorney Brendan Kelly, and seeks money damages, punitive damages, and other legal state law remedies. State’s Attorney Kelly has fought tirelessly against the effects of the opioid epidemic in St. Clair County both prosecuting crime arising from this scourge and now holding the wrongdoers accountable who created it.
