Recently, members of Holland, Groves, Schneller & Stolze, LLC obtained the largest FELA judgment in United States history, $17 MILLION.   The firm also obtained a $4 Million FELA verdict in Miami-Dade County, Florida, followed by two of the largest FELA verdicts in the United States for "whole body vibration" claims, $1.2 Million and $1.769 Million respectively.  Additionally, the firm holds a number of jury verdict records from cases across the country, including the largest FELA verdicts in the history of Florida, Missouri and Kansas as well as three consecutive years with the largest railroad injury verdicts in Missouri.  These results are just a few in a long line of the firm's courtroom successes....more

A U.S. District Court Judge recently agreed with Holland, Groves, Schneller & Stolze, LLC in rejecting the Norfolk Southern Railway Company's attempt to avoid FELA liability by calling one of its switchmen a "maritime worker."  The plaintiff was injured at an east coast coal loading facility that the railroad claimed made his exclusive remedy the federal Longshore Act, a workers' compensation scheme for federal harbor workers.  The Honorable Rodney W. Sippel issued an 8-page order rejecting this tactic and ordering that the case be tried as a FELA case.

In a recent decision by the U.S. 7th Circuit Court of Appeals, the Court cited the testimony of a high-ranking company official as unbelievable, ruling that the railroad must comply with Illinois state rules on walkways. In a stinging opinion, the Court also pointed out the Norfolk Southern "omission" of relevant information was "telling," going on to say "talk is cheap."

This letter is in regard to the Federal Railroad Administration's (FRA) CSX Transportation (CSXT) Harrassment and Intimidation Investigation Report dated March 2008 (the Investigation Report).  Specifically I am concerned that CSXT has not made sufficient progress to remediate its culture of harrassent and intimidation in connection with injury reporting.

Chicago-area Railroad Disputes FELA Coverage for Workers:  Metra Railroad has recently attempted to have two FELA cases thrown out of court, claiming in signed court papers that FELA does not apply.  Both cases were filed in court by or on behalf of Metra Police Officers, whom the railroad now claims were not working "in furtherance of interstate commerce," despite overwhelming evidence to the contrary.
